Terms of Service

By accessing or using NestClearly ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users of the Platform, including sellers, buyers, park managers, lenders, movers, and visitors.

NestClearly is an online marketplace that connects private sellers and buyers of manufactured homes, and provides tools, resources, and directories related to manufactured home ownership, financing, transportation, and community placement. NestClearly is not a real estate broker, mortgage lender, financial advisor, or legal advisor. We do not represent buyers or sellers in any transaction. All transactions are conducted directly between users.

To list a home or access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when creating your account and to update that information as necessary. NestClearly reserves the right to suspend or terminate accounts that contain false or misleading information.

By submitting a listing, you represent and warrant that: • You are the legal owner of the home or are authorized to list it for sale. • All information in your listing is accurate and not misleading. • The home is legally available for sale and is not subject to any undisclosed liens, encumbrances, or legal disputes. • You will promptly update or remove your listing if the home is sold or is no longer available. NestClearly reserves the right to remove any listing that violates these rules or that we determine, in our sole discretion, is inappropriate, fraudulent, or harmful to other users.

Listing fees are charged as described on our Pricing page. All fees are non-refundable except as expressly stated in our refund policy. NestClearly may receive referral fees from lenders, movers, or other service providers listed on the Platform. Where such relationships exist, they are disclosed. These relationships do not affect our editorial independence or the ratings and reviews displayed on the Platform.

You agree not to: • Post false, misleading, or fraudulent listings or information. • Use the Platform to harass, threaten, or harm other users. • Scrape, copy, or reproduce Platform content without written permission. • Use automated tools to access or interact with the Platform. • Attempt to circumvent any security features of the Platform. • Use the Platform for any unlawful purpose.

NestClearly provides the Platform "as is" and makes no warranties, express or implied, regarding the accuracy, completeness, or reliability of any listing, valuation estimate, lender information, or other content on the Platform. Valuation estimates provided by our Home Valuation Estimator are approximations only and should not be relied upon as professional appraisals. Always consult a qualified appraiser for a formal valuation. Information about lenders, financing options, and loan terms is provided for educational purposes only and does not constitute financial advice. To the maximum extent permitted by law, NestClearly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses arising from transactions between users, reliance on Platform content, or unauthorized access to your account. Our total liability to you for any claim arising from your use of the Platform shall not exceed the amount you paid to NestClearly in the twelve months preceding the claim.

You agree to indemnify and hold harmless NestClearly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your listings, or your violation of these Terms.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

NestClearly reserves the right to modify these Terms at any time. We will notify registered users of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the state in which NestClearly is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that state.
