NestClearly is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and the choices you have regarding your information.
1. Information We Collect
We collect information you provide directly to us, including:
• Account information: name, email address, and password when you create an account.
• Listing information: home details, photos, pricing, and contact preferences when you submit a listing.
• Contact form submissions: name, email, and message content when you contact us.
• Payment information: processed securely through our payment provider; we do not store full card numbers.
• Communications: emails and messages you send to us or to other users through the Platform.
We also collect information automatically when you use the Platform, including:
• Usage data: pages visited, features used, search queries, and time spent on the Platform.
• Device information: browser type, operating system, and IP address.
• Cookies and similar tracking technologies: used to maintain your session, remember preferences, and analyze Platform usage.
2. How We Use Your Information
We use the information we collect to:
• Provide, maintain, and improve the Platform.
• Process your listing submissions and payments.
• Send you transactional emails (listing confirmations, inquiries from buyers, etc.).
• Send you service updates and, with your consent, marketing communications.
• Respond to your questions and support requests.
• Detect and prevent fraud, abuse, and violations of our Terms of Service.
• Analyze usage patterns to improve the Platform.
• Comply with legal obligations.
3. Information Sharing
We do not sell your personal information to third parties.
We share your information only in the following circumstances:
• With other users: your listing information (including contact details you choose to display) is visible to buyers browsing the Platform.
• With service providers: we share information with vendors who help us operate the Platform (payment processing, email delivery, analytics). These providers are contractually required to protect your information.
• With lenders and movers: if you use our Lender Match or Movers tools and submit a contact request, your information is shared with the provider you selected. We disclose referral relationships where they exist.
• For legal reasons: we may disclose information if required by law, court order, or to protect the rights and safety of NestClearly or its users.
• In a business transfer: if NestClearly is acquired or merges with another company, your information may be transferred as part of that transaction.
5. Data Retention
We retain your account information and listing data for as long as your account is active or as needed to provide services. If you delete your account, we will delete your personal information within 30 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or preventing fraud).
6. Security
We implement reasonable technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, and destruction. However, no internet transmission is completely secure, and we cannot guarantee the absolute security of your information.
We strongly recommend using a unique, strong password for your NestClearly account and not sharing your login credentials with others.
7. Your Privacy Rights
Depending on your state of residence, you may have specific rights regarding your personal information under applicable privacy laws.
California Residents — CCPA / CPRA Rights
Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California residents have the following rights:
• Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, our business purposes for collecting it, and the categories of third parties with whom we share it.
• Right to Delete: You may request that we delete the personal information we have collected from you, subject to certain exceptions (such as legal obligations or fraud prevention).
• Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
• Right to Opt-Out of Sale/Sharing: You have the right to opt out of the "sale" or "sharing" of your personal information. NestClearly does not sell your personal information. You can submit an opt-out request at nestclearly.com/do-not-sell.
• Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights. Your access, pricing, and service quality will not be affected.
We will respond to verifiable consumer requests within 45 days. If we need additional time, we will notify you of the extension (up to 90 days total).
Virginia, Colorado, Connecticut, and Other State Residents
If you reside in Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), Oregon (OCPA), Montana (MCDPA), Tennessee, Iowa, Indiana, Delaware, New Hampshire, New Jersey, Nebraska, Maryland, or Minnesota, you may have similar rights under your state's privacy law, including:
• Right to access your personal data.
• Right to correct inaccuracies in your personal data.
• Right to delete your personal data.
• Right to obtain a portable copy of your data.
• Right to opt out of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.

8. Children's Privacy
NestClearly is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will delete it promptly.
9. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify registered users of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Policy.
